    This website is operated by LOST iN City Guides (“LOST iN”). Throughout these terms, “we”, “us” and “our” refer to LOST iN City Guides, and “you” refers to the visitor, reader, customer, or member using any part of the Service.

    LOST iN offers this website, our digital guides, our membership program, our AI travel concierge, our newsletter, and our print products (together, the “Service”). Your use of the Service is conditioned on your acceptance of the terms, conditions, and policies set out here.

    By visiting the site, subscribing to the newsletter, purchasing a product, signing up for membership, or otherwise using the Service, you agree to be bound by these Terms of Service (“Terms”), including any policies referenced by hyperlink. These Terms apply to all users, including readers, customers, members, and contributors.

    Please read these Terms carefully. If you do not agree to all of them, please do not use the Service.

    New features, products, or tools added to the Service will also be subject to these Terms. The most current version is always available on this page. LOST iN reserves the right to update, change, or replace any part of these Terms by posting updates here, and your continued use of the Service after changes are posted constitutes acceptance of those changes.

    Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products and services to you.

    1. Eligibility

    By agreeing to these Terms, you confirm that you are at least the age of majority in your state, province, or country of residence, or that you have the consent of a parent or legal guardian to use the Service.

    You may not use the Service for any illegal or unauthorized purpose, and you may not, in your use of the Service, violate any laws in your jurisdiction (including copyright and intellectual property laws).

    You must not transmit any worms, viruses, or code of a destructive nature. A breach or violation of any of these Terms may result in immediate termination of your access to the Service.

    2. General conditions

    LOST iN reserves the right to refuse service to anyone for any reason at any time.

    You understand that your content (excluding payment information) may be transferred unencrypted and may involve transmissions over various networks, and changes to conform to the technical requirements of connecting networks or devices. Payment information is always encrypted during transfer.

    You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, or access to the Service, without express written permission from LOST iN.

    Headings in these Terms are for convenience only and do not limit or otherwise affect the Terms.

    3. The service

    LOST iN produces curated travel content and related products, including:

    • Printed city guides and other physical products

    • Digital city guides and digital editorial content

    • A paid membership program offering editorial content, hotel offers, digital access, and other member benefits

    • An AI travel concierge that surfaces recommendations from LOST iN’s curated editorial library

    • A regular email newsletter

    The exact features, benefits, and inclusions of each product may evolve over time as the Service develops.

    4. Accounts

    To access certain parts of the Service (including membership, digital guides, and the AI concierge), you may be required to create an account.

    You agree to provide accurate, current, and complete information when creating your account, and to keep that information up to date. You are responsible for safeguarding your login credentials and for any activity that takes place under your account.

    LOST iN may suspend or terminate accounts that we reasonably believe to be in breach of these Terms, or where account information appears inaccurate or fraudulent.

    5. Membership

    Membership in LOST iN (“Membership”) is a paid subscription that provides access to a curated set of benefits, which may include digital guides, editorial content, hotel offers, the AI concierge, and other features as described on the Membership page at the time of purchase.

    By purchasing a Membership, you agree to the following:

    • The Membership fee is charged at the rate listed on the sign-up page at the time of purchase.
    • Memberships renew automatically at the end of each term unless cancelled in advance, at the then-current rate, using the payment method on file.
    • You may cancel your Membership at any time through your account or by contacting us. Cancellation takes effect at the end of the current billing period, and you will retain access to member benefits through that date.
    • Membership benefits, partner offers, and included features may change from time to time. Material changes will be communicated in advance where reasonably possible.
    • Membership is personal to you and is not transferable. Sharing of account credentials is not permitted.
    • Except where required by law or stated otherwise on the Membership page, Membership fees are non-refundable once a billing period has begun.

     

    6. Pricing, orders, and billing

    Prices for products and Memberships are subject to change without notice. LOST iN reserves the right at any time to modify or discontinue any product, service, or feature (or any part of it) without notice.

    LOST iN reserves the right to refuse any order. We may, at our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, or the same billing or shipping address. If we change or cancel an order, we may attempt to notify you using the contact details provided at the time of order.

    You agree to provide current, complete, and accurate purchase and account information for all orders. You agree to promptly update your account information, including your email address and payment details, so that we can complete your transactions and contact you as needed.

    7. Digital content and access

    Digital guides, member-only content, and other digital materials made available through the Service are licensed to you for personal, non-commercial use. They are not sold.

    Your right to access digital content is conditional on your Membership being active and in good standing, or on your having purchased the relevant digital product. LOST iN may add, remove, or modify digital content over time, including in response to editorial updates, partner availability, or licensing arrangements.

    You may not reproduce, redistribute, publicly display, scrape, or use digital content as input to train any machine learning model or AI system without our prior written permission.

    8. AI concierge and recommendations

    The AI concierge surfaces recommendations drawn from LOST iN’s curated editorial content, along with related travel information. It is provided as an editorial tool, not as professional travel, financial, medical, or legal advice.

    While we work to keep recommendations accurate and useful, venues, hours, prices, availability, and other details can change at any time. You are responsible for verifying details with the relevant venue, partner, or provider before relying on them, and for ensuring that any travel plans suit your own circumstances.

    LOST iN does not guarantee that the AI concierge will be available without interruption, free of errors, or suited to any particular purpose.

    9. Optional tools and third-party services

    LOST iN may provide access to third-party tools, partners, or services (including hotel booking partners, payment processors, and other integrations).

    You acknowledge and agree that LOST iN provides access to such tools “as is” and “as available”, without warranties, representations, or conditions of any kind, and without endorsement. We have no liability arising from your use of optional third-party tools. Your use of these tools is at your own discretion, and you should review the terms and policies of the relevant third-party provider before using them.

    LOST iN may, from time to time, offer new services or features through the Service, and these will also be subject to these Terms.

    10. Third-party links

    Content available through the Service may include links to third-party websites that are not affiliated with LOST iN.

    LOST iN is not responsible for examining or evaluating the content or accuracy of third-party sites, and is not liable for any third-party materials, products, or services. Please review the policies of any third-party website carefully before using it. Complaints, claims, or questions about third-party products should be directed to the third party.

    11. User submissions

    If you send LOST iN ideas, suggestions, comments, photos, contest entries, or other materials (collectively, “Submissions”), whether requested or not, you agree that LOST iN may, without restriction, edit, copy, publish, distribute, translate, and otherwise use those Submissions in any medium, with credit where appropriate.

    LOST iN is under no obligation to keep Submissions confidential, to pay compensation for Submissions, or to respond to Submissions.

    LOST iN may, but is not obligated to, monitor, edit, or remove content that we determine, in our sole discretion, to be unlawful, offensive, defamatory, infringing, or otherwise objectionable.

    You agree that your Submissions will not violate the rights of any third party, will not contain unlawful, abusive, or obscene material, and will not contain any virus or malware. You may not use a false email address, impersonate someone else, or otherwise mislead LOST iN or any third party as to the origin of any Submission. You are solely responsible for your Submissions.

    12. Personal information and how we improve the service

    Your submission of personal information through the Service is governed by our Privacy Policy.

    In addition, LOST iN may learn from how the Service is used so that we can continue to make it better. This includes things like understanding which guides, features, and recommendations are most useful to our community, how readers and members move through our digital products, and how our products perform over time. Anything learned this way is handled in line with our Privacy Policy, and is intended only to help us refine and improve the Service.

    Where required by applicable law, your choices and consents regarding this use of information are governed by the relevant settings and options described in the Privacy Policy.

    13. Acceptable use

    In addition to the other restrictions in these Terms, you agree not to use the Service or its content:

    • For any unlawful purpose, or to solicit others to perform unlawful acts
    • To violate any international, federal, state, provincial, or local laws, regulations, or rules
    • To infringe upon or violate the intellectual property rights of LOST iN or any third party
    • To harass, abuse, insult, defame, intimidate, or discriminate against any person on any basis, including gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability
    • To submit false or misleading information
    • To upload or transmit viruses or any other malicious code
    • To collect or track the personal information of others
    • To spam, phish, pharm, pretext, spider, crawl, or scrape, except in line with publicly posted permissions
    • To train, fine-tune, or otherwise build any machine learning or AI model using LOST iN content without our prior written permission
    • For any obscene or immoral purpose
    • To interfere with or circumvent the security features of the Service

    LOST iN reserves the right to terminate your access to the Service for any violation of these acceptable-use rules.

    14. Accuracy, completeness, and timeliness of information

    LOST iN is not responsible if information made available through the Service is not accurate, complete, or current. Material on the Service is provided for general information only and should not be relied on as the sole basis for any decision without consulting more authoritative sources.

    The Service may contain historical information, which is provided for reference only and may not be current. LOST iN reserves the right to modify the contents of the Service at any time, but has no obligation to update any specific information.

    15. Errors, inaccuracies, and omissions

    Occasionally there may be information on the Service that contains typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. LOST iN reserves the right to correct any such errors and to change or update information or cancel orders if any information is inaccurate at any time, including after an order has been submitted.

    All editorial content, photography, illustrations, layouts, designs, logos, and other materials made available through the Service are owned by LOST iN or its licensors and are protected by copyright, trademark, and other intellectual property laws.

    Subject to your compliance with these Terms, LOST iN grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service and its content for your personal, non-commercial use. No other rights are granted, and all rights not expressly granted are reserved.

    17. Modifications to the service and prices

    Prices for products and Memberships are subject to change without notice. LOST iN reserves the right at any time to modify or discontinue the Service, in whole or in part, without notice. LOST iN is not liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

    18. Disclaimer of warranties and limitation of liability

    LOST iN does not guarantee, represent, or warrant that your use of the Service will be uninterrupted, timely, secure, or error-free. LOST iN does not warrant that the results obtained from using the Service will be accurate or reliable.

    You agree that LOST iN may, from time to time, remove the Service for indefinite periods or cancel the Service at any time without notice.

    You expressly agree that your use of, or inability to use, the Service is at your sole risk. Except as expressly stated, the Service and all products and content delivered through it are provided “as is” and “as available”, without representations, warranties, or conditions of any kind, either express or implied, including all implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

    In no case shall LOST iN, our parent and affiliated companies, or our directors, officers, employees, contractors, agents, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the Service or any product procured using the Service, or for any other claim related in any way to your use of the Service. Where applicable law does not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law.

    19. Indemnification

    You agree to indemnify, defend, and hold harmless LOST iN, and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

    20. Severability

    If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any remaining provisions.

    21. Termination

    The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

    These Terms are effective unless and until terminated by either you or LOST iN. You may terminate these Terms at any time by notifying LOST iN that you no longer wish to use the Service, or by ceasing to use the Service. If you hold an active Membership, cancellation of that Membership is handled as described in Section 5.

    If, in our sole judgment, you fail (or LOST iN suspects that you have failed) to comply with any term or provision of these Terms, LOST iN may also terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.

    22. Entire agreement

    The failure of LOST iN to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

    These Terms, and any policies or operating rules posted by LOST iN on the Service, constitute the entire agreement and understanding between you and LOST iN, and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, or proposals, whether oral or written, between you and LOST iN.

    Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

    23. Governing law

    These Terms, and any separate agreements through which LOST iN provides services to you, shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of-law principles.

    24. Changes to these terms

LOST iN reserves the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates here. It is your responsibility to check this page periodically for changes. Your continued use of the Service after any changes are posted constitutes acceptance of those changes.
